Актуальность. В условиях специальной военной операции криминальный феномен «чёрных вдов» переродился в высокодоходный преступный бизнес, построенный на гибели военнослужащих. В основе схемы, как показывают данные уголовных дел и материалов прессы, лежит фиктивный брак мошенниц с бойцом СВО для похищения выплат, которые государство направляет ему или его семье. То, как именно трансформировалась преступная стратегия «чёрных вдов», получив новую форму и беспрецедентный размах, до сих пор не становилось предметом научной дискуссии. Отсутствие доктринального осмысления этой преступной модели оставляет правоприменителя без методического инструментария, пригодного для своевременного выявления и предупреждения таких посягательств.
Цель ‒ дополнение теории криминологии новым знанием о мошенничестве, построенном на фиктивных браках с участниками СВО, и разработка оригинальной классификации потерпевших от него.
Задачи: раскрыть механизм корыстных действий, совершаемых «подставными жёнами» против военнослужащих; выделить и охарактеризовать категории жертв, раскрыв факторы их виктимизации.
Методология. Исследование проведено с использованием формально-логического метода, контент-анализа (СМИ, Telegram-каналы, оперативные сводки), а также метода типологизации.
Результаты. Впервые научно верифицирована новая разновидность преступного обогащения, основанная на браке-имитации с участником СВО. Она характеризуется серийностью эпизодов, высокими количественными показателями (сотни потерпевших, многомиллионный ущерб), широкой географией, организованностью (многосубъектный состав) и коррупционной составляющей. Предложена оригинальная классификация жертв, включающая пять категорий, для каждой из которых описан собственный механизм виктимизации.
Выводы. Масштаб этого криминального промысла, его устойчивость и способность к самовоспроизводству позволяют рассматривать его как самостоятельный сегмент корыстной преступности, ориентированной на присвоение выплат военнослужащим. Помимо прямого ущерба, особая опасность видится в том, что эта преступная схема постепенно нормализуется: публичная демонстрация её как «бизнесплана» свидетельствует об утрате социумом ее восприятия как девиации и приобретении черт социальной нормы.
Relevance. In the context of the special military operation, the criminal phenomenon of “black widows” has degenerated into a highly lucrative criminal enterprise predicated on the death of military personnel. As evidenced by the materials of criminal cases and press reports, the underlying scheme involves a sham marriage between female fraudsters and an SMO combatant for the purpose of misappropriating payments directed by the state to the service member or the service member's family. The specific manner in which the criminal strategy of «black widows» has transformed, acquiring a new form and an unprecedented scale, has not yet become the subject of scholarly discussion. The absence of a doctrinal conceptualization of this criminal model leaves law enforcement authorities without the methodological toolkit suitable for the timely detection and prevention of such encroachments.
Purpose ‒ to supplement criminological theory with new knowledge concerning fraud based on sham marriages with SMO participants, and to develop an original classification of the victims thereof.
Objective: to delineate the mechanism of mercenary acts perpetrated by “front wives” against military personnel; to identify and characterize the categories of victims, revealing the factors of their victimization.
Methodology. The research was conducted employing the formal-logical method, content analysis (mass media, Telegram channels, operational briefs), and the method of typologization.
Results. For the first time, a novel variety of criminal enrichment, based on simulated marriage with an SMO participant, has been scientifically verified. It is characterized by a serial nature of episodes, high quantitative indicators (hundreds of victims, multimillion-rouble damage), broad geographic scope, a structured character (multiplesubject composition), and a corruption component. An original classification of victims is proposed, comprising five categories, for each of which a distinct victimization mechanism is described.
Conclusion. The scale of this criminal enterprise, its sustainability, and its capacity for self-reproduction allow it to be regarded as an independent segment of mercenary crime oriented toward the appropriation of payments to military personnel. Beyond direct damage, particular danger is seen in the fact that this criminal scheme is gradually being normalized: its public presentation as a «business plan» testifies to the loss, by society, of its perception as deviance and its acquisition of features characteristic of a social norm.
