Актуальность. Культура – неотъемлемый элемент любого общества, государства, неразрывно связанная с национальными интересами. В Российской Федерации культура в широком смысле этого слова не только представляет собой элемент российской идентичности, но и выступает объектом государственной охраны. С учетом современных вызовов и угроз, «отмены» российской культуры в ряде недружественных государств, необходимости более глубокого погружения в объективную правовую картину механизма реализации национальных интересов в сфере культуры в настоящее время назрела необходимость определения status quo национальной правовой политики в сфере культуры.Цель состоит в уяснении значения российской правовой политики в сфере культуры на современном этапе развития российского государства.Задачи исследования: установить состояние современной правовой политики в сфере культуры; определить место культуры в системе «национальный интерес – национальный приоритет»; оценить содержание стратегических документов в сфере государственной культурной политики.Методология. В работе использовались в совокупности общенаучные (анализ, описание, интерпретация, системный анализ) и частнонаучные (формально-юридический, метод толкования правовых норм) методы. Основой исследования явился всеобщий диалектический метод научного познания.Результаты исследования показали, что правовая политика в сфере культуры лишь частично отражается в стратегических документах. Отмечены негативные изменения их содержания, которые представляются непродуманными.Вывод. Правовая политика в сфере культуры требует переосмысления и более интенсивного развития. Признание культуры в качестве стратегического национального приоритета несколько нивелирует ее значение для российской государственности и самоидентичности, несмотря на пристальное внимание со стороны государства и безусловный стратегический потенциал обеспечения национального суверенитета.
Relevance. Culture is an intrinsic element of any society and state, inextricably linked to national interests. Within the Russian Federation, culture in the broad sense constitutes not only a fundamental component of national identity but also an object of state protection. In light of contemporary challenges and threats, including the boycott and marginalization of Russian culture by a number of unfriendly states, alongside the imperative for a deeper analysis of the legal mechanisms for realizing national interests in the cultural domain, there is a pressing need to define the status quo of national legal policy in this sphere.Purpose. This study aims to clarify the significance of Russian legal policy in the field of culture at the present stage of the state's development.Objectives. The research objectives are: to ascertain the current state of legal policy in the sphere of culture; to determine the position of culture within the "national interest – national priority" framework; to evaluate the content of strategic documents pertaining to state cultural policy.Methodology. The study employed a combination of general scientific methods (analysis, description, interpretation, systems analysis) and specific legal methods (formal-legal analysis, legal norm interpretation). The universal dialectical method of scientific cognition served as the foundational methodology.Results. The analysis revealed that the current legal policy in the sphere of culture is only partially reflected in strategic documents. The research identified negative developments in their content, which appear to be poorly conceived and lack substantive justification.Conclusion. Legal policy in the cultural sphere requires conceptual re-evaluation and more dynamic development. The formal recognition of culture as a strategic national priority, while indicative of state attention, inadvertently fails to capture its profound significance for Russian statehood and self-identity, thus underestimating its strategic potential for ensuring national sovereignty.
