Antichresis: a legal relic of the past or a promising model of property law

Abstract

Relevance. Antichres is one of the oldest categories of civil law. At the same time, it can be considered a very modern concept, given the updated civil legislation in a number of foreign countries. Given the incomplete development of the domestic doctrine of property law, it is highly relevant to analyze the potential applications of antichres in Russia.

The purpose of this study is to form a comprehensive understanding of the anti-chresis model as a type of property law and to assess the prospects for its use in Russian civil legislation.

Objectives: to highlight the processes of the emergence (genesis) and subsequent development of the antichres; to determine its legal nature; to establish the patterns of its development in the countries of South America; to identify the social opportunities for using this property right on the example of the civil legislation of Catalonia; to formulate the qualitative characteristics and determine the social significance of introducing the antichres into civil legislation.

Methodology. The article is based on a complex of general scientific (logical, systemic) and private scientific (formal-legal, comparative-legal) approaches for analyzing civil law phenomena. The method of legal norms interpretation and historical-legal method are used.

Results. The economic and legal significance of anti-chresis lies in the creditor's acquisition of the rights to own and use the debtor's real estate, while generating income aimed at collecting the debt under the main obligation. In today's context, anti-chresis serves as a flexible tool for the creditor to ensure their interests through effective management. It is reasonable to consider the formation of anti-chresis as an independent property right.

Conclusion. The formulated research results can be used by the legislator to further improve the system of limited property rights in accordance with the realities of modern socio-economic life.
